In exchange, they let employers off-the-hook for legal liability in a construction accident that injures an employee. In other words, because workers’ comp covers construction workers in the event of an accident, injured workers cannot sue their employers for their injuries.
However, that rule only applies to suing employers. If someone other than an employer (or a co-worker) made a bad decision or took a dangerous action that led to a construction accident, then regardless of workers’ comp, a construction worker injured in the accident may still have the right to sue that so-called “third party” for damages. Who might have liability as a “third party”?
- Another contractor: On any Bronx construction site, employees of multiple different contractors typically work side-by-side. An accident caused by employees of one contractor can injure the employees of another. In that case, the contractor of the employees who caused the injuries may have liability.
- A motor vehicle driver: Road construction projects in the Bronx can put workers at risk of collisions with cars and trucks. A road construction worker injured in a collision with a motor vehicle may have the right to take legal action against the driver.

I got hurt as a worker on a Bronx construction site. What are my rights to compensation?
As a worker who suffered an injury on a Bronx construction site, you likely have the right to receive compensation from at least one of the following sources:
- Workers’ compensation insurance. Virtually all Bronx construction workers have the right to receive compensation from an employer-provided workers’ compensation insurance policy for any injury that they suffer on a job site in connection with their work. Workers’ comp pays for medical and disability-related expenses related to an on-the-job injury or illness, regardless of fault for the injury.
- Labor Law §200, §240 (the “Scaffold Law”), & §241. New York statutes offer added protection for Bronx construction workers subjected to certain unsafe conditions on job sites (other than work on one and two family dwellings). These laws generally require property owners, general contractors, and their agents to provide a safe worksite, and subject them to legal liability for injuries workers suffer. Under the so-called “Scaffold Law”, those parties’ can even have absolute (or strict) liability for injuries involving falls (or falling objects). Liability under these laws applies to any owner, general contractor, or agent who is not the worker’s employer.
- Third party claims. Bronx construction workers injured because of the wrongful decisions or actions of a third party on or in connection with a job site (someone other than their employer or co-worker), may also have a legal claim for damages against that third party. For example, the manufacturer of a piece of defective construction equipment that injures a worker may have liability for the worker’s injuries.
There is no absolute guarantee that a worker has the right to receive compensation from all (or, indeed, any) of the sources above, of course. Every Bronx construction incident has its own unique facts and circumstances that determine a worker’s rights. Does that mean I can sue someone for my injuries?
Possibly, but not always. Here’s what we mean.
If you are one of the vast majority of Bronx construction workers covered by workers’ compensation insurance against the costs of an on-the-job injury, then in most cases you cannot sue your employer or co-worker for causing your injury. Under New York workers’ compensation law, your exclusive remedy against your employer is collecting workers’ compensation benefits.
This might seem a little unfair if, say, your employer caused your injury by violating work safety rules, but the trade-off is that you also have the right to receive workers’ comp benefits even if you bear the blame for your own injury (so long as you were not intoxicated when it happened, and did not intentionally hurt yourself).
That said, if your injury resulted from either a violation of one of the three Labor Law provisions above, or from the wrongful actions of a third party, then you might also have the right to sue a property owner, general contractor, contractor’s agent, or some other legally-liable third party for your injuries.
In rare cases, you might also have the right to sue your own employer, such as if your employer did not carry workers’ compensation insurance as required, or if your employer intentionally caused you harm. Finally, if you suffered an injury on a job site while there in some capacity other than as a worker, then you likely have a right to sue anyone at fault for causing you harm.
Finally, you may well need to sue the workers’ comp insurance company to get the benefits you deserve.

How much money can I get for my Bronx construction injuries?
It really depends on the specific facts and circumstances of your Bronx construction accident, and which of the sources of compensation described above you might have the right to pursue.
Workers’ compensation insurance benefits. Workers’ compensation insurance provides three general categories of benefits for most workers and their families.
- Medical benefits that pay 100 percent of the cost of medical care for a work-related injury, including all emergency care, hospitalizations, doctor visits, medications, medical equipment, and therapy;
- Cash benefits that pay 66 ⅔ percent of your weekly wage, multiplied by your percentage of disability, for the period of time that any injury-related disability keeps you out of work or unable to work in the same capacity as before; and
- Death benefits for families of Bronx construction workers who die in construction site incidents, which pay weekly benefits similar to the cash benefits above, plus a fixed amount for funeral and burial expenses.
Workers’ compensation insurance pays most of your medical benefits directly to medical providers. So, the amount of money that goes into your pocket as benefits depends upon your wage and your percentage of disability. Financial damages obtained through lawsuits. If you also receive workers’ comp benefits for your injury, then any money you recover through a lawsuit will first go to paying back the workers’ compensation insurance carrier, in most cases.
